Three things worth knowing before you read the rest

OH! is not a medical practice. We provide technology and administrative support. Clinical decisions are made independently by licensed clinicians.

Nothing on this site is medical advice. It is general information. Your clinician's guidance governs.

A prescription is not guaranteed. Paying does not entitle you to medication. If a clinician determines treatment is not appropriate for you, you are not charged for it.

1. Eligibility

You must be 18 or older, located in a state where we operate, and able to form a binding contract. You agree to provide accurate information about yourself, including your complete medical history and current medications. Incomplete or inaccurate health information can lead to unsafe treatment decisions. This is the single most important obligation you have under these Terms.

2. The relationship between OH! and your clinician

OH! is a technology and administrative services company. It does not employ clinicians to exercise clinical judgment and does not direct clinical decision-making.

Clinical services are provided by independently licensed clinicians affiliated with [AFFILIATED PROFESSIONAL ENTITY]. Pharmacy services are provided by [PHARMACY PARTNER]. Your clinician exercises independent professional judgment and may decline to prescribe.

3. Not medical advice, and not an emergency service

Content on this site is general health information, not a diagnosis, treatment recommendation, or substitute for care from a clinician who has examined you.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency department. OH! is not monitored for emergencies and must never be used to report one.

Keep your credentials confidential and tell us promptly at support@getoh.co if you suspect unauthorized access. You are responsible for activity under your account. Because your account may contain health information, we recommend a unique password and two-factor authentication where offered.

We may suspend or terminate accounts for violations, and will report conduct we are legally required to report.

7. Subscriptions, billing, and cancellation

How billing works

Cancelling

You can cancel any time from your account settings in one click. No phone call, no retention offer. Cancellation stops future charges and takes effect at the end of your current billing period. You keep access through the period you have paid for.

Refunds

8. Shipping

Orders ship in unmarked packaging to the address you provide. You are responsible for the accuracy of that address. Risk of loss passes on delivery to the carrier. Some medications cannot ship to certain states; we will tell you before charging you if that applies.

9. Intellectual property

The OH! name, wordmark, site design, and content are owned by us and protected by intellectual property law. You may not copy or reuse them without written permission. You keep ownership of anything you submit, and grant us a limited license to use it to provide the service.

10. Third-party services

The service relies on third parties for payment, shipping, pharmacy, and communications. Their terms govern their services. We are not responsible for their acts or omissions, though we select them carefully and hold them to contractual obligations.

11. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OH! WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF [$200] OR THE AMOUNT YOU PAID US IN THE [12] MONTHS BEFORE THE CLAIM AROSE.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR PERSONAL INJURY CAUSED BY NEGLIGENCE. THESE LIMITATIONS DO NOT APPLY TO THE INDEPENDENT PROFESSIONAL LIABILITY OF YOUR TREATING CLINICIAN. SOME STATES DO NOT ALLOW CERTAIN EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify OH! against claims arising from your misuse of the service, your violation of these Terms, or health information you provided that was materially false.

13. Dispute resolution

[ARBITRATION CLAUSE — DRAFT WITH COUNSEL.] If you include binding arbitration and a class action waiver, it must be conspicuous, must include a clearly explained opt-out window (commonly 30 days), and must comply with the FAA and applicable state law. A carve-out for small claims court is customary. Do not copy another company's clause; enforceability turns on presentation and on your state.

These Terms are governed by the laws of [STATE], without regard to conflict-of-law rules.

14. Changes to these Terms
